IMPLEMENTATION OF THE MASSACHSUETTS UNIFORM PROBATE CODE
On March 31, 2012, a significant recodification of Massachusetts' Probate Law (M.U.P.C.) is scheduled to take
effect. On that date, the Massachusetts Uniform Probate Code will be fully
implemented and operable. The changes will be dramatic and far ranging. These
major developments will not only impact Probate Administration but will be reflected
in the drafting of estate planning documents after the effective date. The most
significant change under the new law will be the implementation of an informal probate process which
will involve minimal contact with the Court. It is expected that this new
procedure will result in the expedited handling of estates at great savings in
cost to the petitioner.
TOPICS TO BE COVERED
How will the new informal probate of wills work?
Will my estate qualify for the informal probate procedure?
What if I am already probating a will? How does
new law apply?
How the old formal probate system will continue
to operate.
New terminology and new rules of inheritance.
Will my present Will be adequate under the new
rules?
How should Wills be written to conform to the
new rules?
Dates and locales to be announced for Spring of 2012 presentations on these topics as they become available.
